This 1973 Plymouth Cuda 340 is a restored classic muscle car with bold character. Legendary Classic Car Auctions
1. All Sales Are Final – No Warranties or Guarantees
All vehicles are sold AS IS, WHERE IS, WITH ALL FAULTS. ALL SALES ARE FINAL—no refunds, exchanges, or returns. Neither Legendary Classic Car Auctions (LCCA) nor the consignor makes any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, authenticity, mileage, condition, or roadworthiness. It is the sole responsibility of the bidder to conduct any and all necessary inspections prior to bidding. LCCA makes no guarantees that any vehicle meets federal, state, or local regulations for registration or operation.
All descriptions, photos, and representations are for reference only and do not constitute a warranty. Bidders must conduct their own due diligence before placing a bid. By bidding, you acknowledge that you have inspected or waived the right to inspect the vehicle to your satisfaction.
2. No Liability for Errors or Omissions
LCCA and its consignors make no representations as to the correctness of descriptions, authenticity, title status, mechanical condition, accident history, or any other detail related to the vehicles offered. Any information provided is for convenience only and may not reflect current or actual condition. All vehicles should be assumed to have unknown defects. Bidders assume all risks, and LCCA is not liable for discrepancies.
3. Auction Process & Discretion of LCCA
The highest bid acknowledged by LCCA will be the winning bid. In case of disputes between bidders, LCCA reserves the right to:
Determine the successful bidder.
Reopen bidding.
Rescind the sale and re-auction the vehicle.
Withdraw any vehicle at any time.
LCCA makes every effort to ensure accuracy in bidding, but if an auctioneer error occurs, LCCA reserves the right to cancel a sale at its discretion.
4. Bidding is Binding & Irrevocable
Placing a bid constitutes a legally binding contract to purchase the vehicle. Bids cannot be retracted for any reason. The winning bidder is obligated to pay in full. Failing to complete payment may result in legal action and permanent banning from future auctions.
Bidders are responsible for securing their accounts. Any bid placed under a bidder’s account is legally binding, even if placed by another party.
5. Buyer’s & Seller’s Premium
A 7.5% buyer’s premium will be added to the final hammer price of each vehicle.
A 7.5% seller’s premium will be deducted from the seller’s proceeds.
6. Payment Terms
Full payment is due within 3 business days of the auction’s end. Acceptable payment methods:
Bank wire transfer (required for transactions over $25,000).
Certified cashier’s check (subject to verification and clearing).
Personal or business checks (vehicles will not be released until funds clear).
Credit cards are NOT accepted for vehicle purchases.
Failure to complete payment within the allotted timeframe will result in cancellation of the sale, legal action, forfeiture of any deposit, and possible suspension from future auctions.
7. Vehicle Pickup & Title Transfer
Buyers are responsible for arranging vehicle pickup and transportation.
Vehicles must be removed from auction premises within 7 business days unless otherwise agreed upon.
Any vehicle left unclaimed beyond 14 days may be subject to storage fees or deemed abandoned and resold at the buyer’s expense.
LCCA does not guarantee titles will be available immediately. Title processing may take up to 30 days.
8. Non-Payment & Liquidated Damages
Failure to complete payment will result in a 15% liquidated damages charge on the hammer price. Additionally, non-payment may result in legal action, collection agency involvement, and reporting to credit bureaus.
9. Seller Representations & Responsibilities
Sellers warrant that they have full legal ownership and authority to sell the vehicle.
Sellers must disclose any title issues, major mechanical problems, and accident history.
LCCA is not responsible for inaccurate seller-provided information.
10. Arbitration & Legal Disputes
Any disputes shall be resolved via binding arbitration in the state of California. By participating in the auction, bidders agree to waive their right to trial in a court of law and must pursue arbitration for any claims.
11. Governing Law
These terms and conditions are governed by the laws of the State of California. By participating in this auction, bidders and sellers agree to be bound by these laws.
